1. Scope
These terms apply to all orders placed through supermarket.berlin with Christopher James Paxton, trading as SUPER, Delbrückstraße 41, 12051 Berlin, Germany ("we", "us"). Conflicting terms of the customer do not apply unless we expressly agree to them.
2. Conclusion of the contract
The products shown in our shop are not a binding offer but an invitation to order. Before submitting your order, you can review all details and correct any input errors. By clicking the final order button at checkout, you submit a binding offer to buy the products in your cart.
The automatic email confirming receipt of your order is not yet an acceptance. The contract is concluded when we accept your offer by email or ship the goods. If you pay with Shopify Payments or PayPal, the contract is concluded when you complete the payment.
3. Contract language and storage of the contract text
The contract language is English. We store the contract text and send you the order details and these terms by email. You can view the current terms on our website at any time.
4. Prices and shipping costs
All prices are final prices including statutory VAT. Shipping costs are charged in addition, as set out in our Shipping policy and shown at checkout. For products sold by weight or volume, we also show the unit price.
5. Payment
You can pay with the methods shown at checkout: Shopify Payments (for example credit or debit card, Apple Pay and Google Pay) and PayPal. Payment is due when you place your order.
6. Delivery and pickup
We deliver within Germany only. Delivery times, costs and pickup conditions are set out in our Shipping policy. If a product is unexpectedly unavailable, we will inform you immediately and refund any payment already made without delay.
7. Alcohol and age requirement
We sell alcoholic drinks only to people aged 18 or over. By ordering, you confirm that you are at least 18. We may ask for proof of age at pickup or on delivery and may refuse to hand over alcohol if proof is not provided. In that case we will refund the price of the alcoholic products.
8. Retention of title
The goods remain our property until full payment has been made.
9. Right of withdrawal
Consumers have a statutory right of withdrawal. Details, including exceptions for opened food and drinks, are set out in our Return and refund policy.
10. Warranty
The statutory warranty rights apply. Please report obvious transport damage to the carrier and to us as soon as possible; failing to do so does not affect your statutory rights.
We ship food with a reasonable remaining shelf life. Ingredient and allergen information is shown on each product page. Recipes can change, so please also check the information on the packaging before eating.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are only liable for breaches of essential contractual obligations, that is obligations whose fulfilment makes proper performance of the contract possible and on which you may regularly rely. In that case our liability is limited to the foreseeable damage typical for this type of contract.
12. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the law of the country where they habitually reside. If any provision of these terms is invalid, the remaining provisions remain valid.
